26. We are an independent contractor, at times working together with other third party vendors in offering these Services and Products to you. We are only responsible for the processing of your bookings and reservations in relation to the Services and your orders for the Products. myepb.com nevertheless adopts a rigorous selection process in appointing such third party vendors, Services and Products. The terms and conditions from each individual third party contractor will however govern the Services provided or Products supplied to you. myepb.com cannot be responsible for the manner or quality of the Services provided or of the Products supplied by such third party vendors. You may send your complaints or claims for any unsatisfactory fulfillment of Services or supply of Products to myepb.com, who will then forward the same to the relevant third party vendors. myepb.com will be willing in appropriate situations to help you to mediate a solution between you and such third party vendors.

27. You acknowledge that the Loyalty Card and/or any unutilised Bonus Points shall have no cash value whatsoever and cannot be exchanged for cash. We shall not be liable to you in any way for loss or damage or to compensate you for any unutilised and/or forfeited Bonus Points or for any termination of this Agreement and/or termination or revision or amendment of the use of the Card, and/or termination of the Loyalty Program.

28. All merchandise and vouchers offered as prizes for contests or redemption shall have no cash value.

29. We reserve the right to change and amend all prizes offered when deemed necessary with a replacement of similar value.

30. We do not guarantee continuous availability or access to the Web Site. We also reserves the right to change the look and feel of the Web Site or any part thereof from time to time.

33. The use of this Web Site, the Services and the Products provided hereunder are subject to all applicable local laws relating to the Internet. You agree to:

Any such notice, demand or communication shall be deemed to have been effectively served on the day following posting if sent by post or immediately if published on the Web Site or in the newspapers. You shall notify us in writing of any change of name or mailing address, at the first reasonable opportunity after such change.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, these Terms constitute the entire agreement between us and you with respect to the application and acceptance of your registration as an member and supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between us and you in respect of the same.

A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. The section titles in these terms are solely used for the convenience of the parties and have no legal or contractual significance.
